Ultimate Sun Tracker (by The Circadian Bros, LLC)

These Terms of Service ("Terms") govern your use of the Ultimate Sun Tracker mobile application (the "App"), operated by The Circadian Bros, LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. The App and Its Purpose

Ultimate Sun Tracker provides personalized guidance for sun exposure, vitamin D, and circadian health, including daily plans, session tracking, UV and solar information, and educational content.

The App is for general wellness and educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The information and plans it provides are based on general research and the details you enter, and they are not a substitute for professional medical judgment. Always consult a qualified healthcare provider before making decisions about sun exposure, supplementation, or your health — especially if you have a medical condition, take medication, or have concerns about your skin. Overexposure to the sun carries real risks, including sunburn and long-term skin damage. You are responsible for your own sun exposure and for using the App sensibly.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement and that the information you provide is accurate.

3. Your Account

Some features require an account. You are responsible for keeping your login credentials secure and for activity under your account. You can delete your account at any time within the App (Profile → Delete Account).

4. Subscriptions and Purchases

The App offers an optional paid subscription ("Premium") that unlocks additional features.

  • Billing: Subscriptions are billed through your Apple App Store account (or the applicable app store). Payment is charged at confirmation of purchase.
  • Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
  • Managing and canceling: You can manage or cancel your subscription in your App Store account settings. Deleting the App does not cancel your subscription.
  • Refunds: Purchases are handled by the app store, and refunds are subject to the app store's policies. We generally do not control or issue refunds directly.
  • Price changes: We may change subscription prices. Any change will apply to future billing periods and, where required, only after notice to you.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, copy, or interfere with the App or its systems
  • Access the App through unauthorized means or disrupt its operation
  • Misuse or attempt to gain unauthorized access to other users' data

6. Intellectual Property

The App, including its content, design, plans, and educational materials, is owned by The Circadian Bros, LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable, non-exclusive license to use the App for your own personal use. You may not reproduce or distribute our content without permission.

7. Disclaimers

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the App will be error-free, uninterrupted, or that its information, estimates, or plans will be accurate or suitable for your circumstances. Vitamin D estimates, UV data, and solar timing are approximations and may differ from actual conditions.

8. Limitation of Liability

To the fullest extent permitted by law, The Circadian Bros, LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any harm arising from your use of the App or your sun exposure. Our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim.

9. Changes to the App or These Terms

We may modify or discontinue the App, or update these Terms, at any time. When we update these Terms, we will revise the "Last updated" date. Your continued use of the App after changes take effect means you accept the updated Terms.

10. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete your account at any time.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.
